About DUI Charges in Georgia
There are two types of DUIs in Georgia; the first one being the traditional DUI and the second one occurs when the driver’s alcohol level is over the legal limit. For traditional DUI cases, the prosecution needs to prove that the defendant was less safe due to the influence of alcohol. Traditional DUI cases generally do not require the prosecution to have absolute, concrete evidence of intoxication. Also, DUI cases in Georgia can be prosecuted not just for alcohol, but for any other controlled substance as well. Defendants can be charged with a DUI if they are under the influence of legal or illegal substances and illegal drug charges can be added on top of the other charges.
For cases where the defendant was over the legal alcohol limit, the defendant needs to go through a breath, urine, or blood test to determine their level of intoxication. In these types of cases, the prosecution is not required to prove that the defendant was less safe, only that the defendant’s alcohol level exceeded the legal limit of 0.02 for those under 21 or 0.08 for those over 21.
