    1. Are estate planning lawyers different from will lawyers?

    On the other hand, will lawyers only draft wills, notarize the document and the work is done for them. Within 10 minutes of consultation, they will directly come to the point and ask you questions such as “who should be the executor?” or “who are your legal heirs?”

    2. Can I make a joint will?

    Yes, you can. In this type of will, a co-testator (usually your spouse) signs the document. So, in the event, if one dies, the surviving partner will get everything. And if both become victims of a mishap and die, everything would go to their children.

    However, we do not recommend making a joint will, it can create long-term problems among your children due to confusions. Also, if either party changes their mind or wishes to amend the will, things may become complicated.

    3. What are the benefits of having living trusts?

    There are several benefits of having living trusts:

    • Saves time & money:
      With a living trust, your trustee can immediately take care of funeral expenses and distribute the assets without waiting for the probate. Less probate waiting time means more savings.
    • Better protection if challenged:
      Living trusts are less likely to be challenged than a simple will.
    • Protects privacy:
      A general will is a public document and anyone can get a copy of the same. However, living trust is a private document that can only be viewed when the trustee wants to share the information.
    4. Is it okay if I don’t want to create a will?

    It’s your personal choice. However, if you die without a will, the probate court will distribute your assets as per the local “intestate succession” laws.
